Terms and Conditions

Scope of Application

These Terms and Conditions (T&Cs) govern the use of the online platform Padel The City (“Platform”) by users (“Customers”) and the booking of padel courts, training sessions, or similar services (“Services”) through the Platform. The Platform is operated by GonzalezInvest, Sole Proprietorship, [Address, Switzerland].

Role of Padel The City

Padel The City provides a platform where providers of padel-related services can present their offers and where customers can book these services. The actual service (e.g. training or court use) is provided by the respective provider. The contract for the service is concluded exclusively between the customer and the provider. Padel The City is responsible for organizing the booking and processing payments, but not for performing or ensuring the quality of the service.

Registration and User Accounts

Customers may create a user account on the Platform. Registration is permitted only for persons of legal age (18 years or older). Customers must provide complete and accurate information when registering and keep their login credentials confidential. Users are responsible for all activities carried out through their account. Padel The City reserves the right to block or delete user accounts at any time in case of a violation of these T&Cs or misuse.

Reviews and Content

Customers may submit reviews about providers and services after a booking. Reviews must be factual, truthful, and fair. Offensive, discriminatory, misleading, or unlawful content is prohibited. Padel The City reserves the right to review, edit, or delete reviews at any time, especially if they violate these rules. By submitting a review, the customer grants Padel The City a free, perpetual, and worldwide right to use, reproduce, and distribute the review.

Booking Process

Bookings are requested through the Platform and manually confirmed by Padel The City. A booking becomes binding only once it is explicitly confirmed by Padel The City. Padel The City forwards booking details to the provider and coordinates confirmation of the appointment.

Prices and Payments

All displayed prices include essential costs and taxes unless otherwise stated. Obvious price errors (“manifest errors”) are not binding. Payment for the booking is processed through Padel The City. Padel The City collects payments on behalf of and for the account of the provider and transfers them to the provider after the service has been rendered. Currency conversions may result in slight variations; additional bank charges are the customer’s responsibility.

Withdrawal, Cancellations, and Changes

Under Swiss law, there is no statutory right of withdrawal for online bookings of services (such as training sessions or court reservations). Withdrawal is only possible under the following cancellation terms. Cancellations must be made via the Platform or in writing by email to hello@padelthecity.com. The cancellation periods and fees specified during the booking process for each provider apply. If a cancellation is made within the free cancellation period, the full amount will be refunded. If the cancellation occurs after the deadline or the customer fails to appear (“no-show”), there is no entitlement to a refund. In the event of rain, Padel The City will make every reasonable effort to cancel affected training sessions or reschedule them together with the provider, but cannot guarantee this. If the provider cancels the booking, the amount paid will be refunded via the original payment method. Refunds are made exclusively through the Platform and to the payment method used at purchase. Padel The City is not responsible for any costs or damages related to third-party services not booked through the Platform (e.g. travel, accommodation, or transportation costs). Customers are advised to take out appropriate insurance if necessary.

Customer Obligations

Customers must provide accurate information during registration and booking. Customers may not use the Platform for unlawful or abusive purposes. Inappropriate behavior toward providers, their staff, or other customers may result in account suspension.

Liability

Padel The City is liable for the proper handling of bookings and payments. The provider is solely responsible for the performance and quality of the booked service. Padel The City accepts no liability for accidents, injuries, or damages that occur in connection with the use of the padel facility or participation in training sessions. Customers are responsible for maintaining adequate insurance coverage. Padel The City does not guarantee the continuous availability or error-free operation of the Platform. Liability for slight negligence, consequential damages, or loss of profit is excluded to the extent permitted by law.

Indemnification

Customers and providers agree to indemnify and hold harmless Padel The City from any third-party claims arising from incorrect information, breaches of duty, or other conduct attributable to them.

Ranking and Sorting

The order in which providers and services appear on the Platform is determined by Padel The City’s internal criteria (e.g. relevance, availability, quality of information, reviews) and may vary.

Intellectual Property

All content on the Platform (texts, images, logos, designs) is protected by copyright or other rights. Any use without prior written permission is prohibited.

Data Protection

Personal data is processed in accordance with Padel The City’s Privacy Policy.

Amendments

Padel The City may amend these Terms and Conditions at any time. The version published on the Platform is binding.

Governing Law and Jurisdiction

These Terms are governed exclusively by Swiss law. The place of jurisdiction is the registered office of GonzalezInvest, Sole Proprietorship, unless mandatory legal jurisdictions apply.
