Terms and Conditions

Scope of Application
These Terms govern the use of the Padel The City platform and all bookings made through the platform, including coach bookings, court reservations, premium experiences, camps, retreats, tournaments, and travel-related services.

Role of Padel The City
Padel The City operates an online marketplace connecting customers with independent coaches, clubs, and premium experience organizers.
For coaching sessions, court bookings, and local services, Padel The City may facilitate bookings and collect payments on behalf of providers.
For premium experiences, camps, retreats, tournaments, and travel-related services, Padel The City acts solely as an intermediary (Vermittler). The experience provider identified on the experience page is the Organizer (Veranstalter). The contract for the experience is concluded directly between the customer and the Organizer.
Padel The City does not employ, supervise, or control independent coaches, clubs, accommodation providers, transportation providers, or experience organizers. These parties operate independently and are solely responsible for their services, licenses, insurance coverage, and compliance with applicable laws.

Booking Process
Bookings become binding only after confirmation. Padel The City may transmit booking information between customers and providers but is not responsible for the delivery of services by third-party providers.

Prices and Payments
Coach Bookings:
Payments may be processed through Padel The City on behalf of the coach or service provider.
Premium Experiences:
Payments are generally made directly to the Organizer. If Padel The City facilitates payment collection, it does so solely as an intermediary and not as the Organizer of the experience.
Where Padel The City collects payments on behalf of a coach, club, or Organizer, such collection does not make Padel The City the provider or organizer of the booked service. Payment collection is performed solely as an administrative and intermediary service.
Premium Experiences and Package Travel
Padel The City is not the organizer, tour operator, travel provider, or package travel provider unless expressly stated otherwise.
The Organizer is solely responsible for:
• Delivery of the experience
• Accommodation and transportation included in the package
• Safety and participant welfare
• Compliance with travel and tourism laws
• Cancellations, itinerary changes, and refunds
• Insolvency protection where legally required
The Organizer’s terms and conditions apply to the experience booking.
Customers are responsible for obtaining valid passports, visas, travel authorizations, vaccinations, health documentation, and travel insurance where required for participation in an experience or travel package.

Withdrawal, Cancellations and Changes
Cancellation terms vary by provider and Organizer and are disclosed during booking. Refund rights are determined by the applicable provider or Organizer terms and mandatory consumer protection laws.

Organizer Responsibility
Where an Organizer qualifies as a package travel organizer, tour operator, or provider of travel services under applicable law, the Organizer alone bears all legal obligations arising from such status, including consumer protection obligations, insolvency protection requirements, information obligations, and liability for the performance of travel services.
Padel The City does not assume any responsibilities or liabilities that are legally assigned to the Organizer unless expressly stated otherwise in writing.

Force Majeure
Neither Padel The City nor the Organizer shall be liable for delays, cancellations, or failure to perform caused by events beyond reasonable control, including natural disasters, pandemics, government actions, strikes, transportation disruptions, security incidents, or similar force majeure events.

Customer Obligations
Customers must provide accurate information and use the platform lawfully. Abusive, fraudulent, or inappropriate conduct may result in account suspension.

Reviews and User Content
Reviews must be honest, lawful, and respectful. Padel The City reserves the right to remove content that violates these Terms.

Platform Availability
Padel The City strives to maintain continuous availability of the Platform but does not guarantee uninterrupted access. Access may be suspended, restricted, or interrupted temporarily due to maintenance, updates, technical issues, security measures, or circumstances beyond our reasonable control.

Participation and Assumption of Risk
Participation in sports activities, coaching sessions, tournaments, retreats, and related experiences involves inherent risks, including the risk of injury, illness, property damage, or other losses.
Customers participate voluntarily and acknowledge these risks.
To the maximum extent permitted by law, Padel The City shall not be liable for injuries or damages arising from activities provided by independent coaches, clubs, Organizers, or other third-party providers.

Liability
Padel The City is responsible only for operation of the platform and, where applicable, booking and payment processing.

For premium experiences, the Organizer is solely responsible for performance of the experience. Padel The City shall not be liable for cancellations, delays, injuries, accommodation issues, transportation issues, or other matters arising from services provided by Organizers or third parties.

Nothing in these Terms excludes liability where exclusion is prohibited by mandatory law.
To the maximum extent permitted by applicable law, Padel The City’s liability is limited to direct damages resulting from intentional misconduct or gross negligence.

Padel The City shall not be liable for indirect, incidental, consequential, special, punitive, or loss-of-profit damages arising from the use of the Platform or services provided by third parties.

Data Protection
Personal data is processed in accordance with the Privacy Policy and applicable Swiss and European data protection laws.

Intellectual Property
All content on the Platform (texts, images, logos, designs) is protected by copyright or other rights. Any use without prior written permission is prohibited.

Amendments
Padel The City may amend these Terms and Conditions at any time. The version published on the Platform is binding.

Governing Law and Jurisdiction
These Terms are governed exclusively by Swiss law. The place of jurisdiction is the registered office of MeyerGonInvest, Sole Proprietorship, unless mandatory legal jurisdictions apply.
